Please read these Terms and Conditions carefully before using the TomaShiftWC mobile application ("the App") developed by Tomahawk Internet Technologies ("we," "our," or "us"). By downloading or using the App, you agree to be bound by these terms.

1. Acceptance of Terms

By installing, accessing, or using TomaShiftWC, you confirm that you are at least 18 years of age, are an authorized employee or user of a TomaShift workforce management platform, and agree to these Terms and Conditions in full.

2. Description of the App

TomaShiftWC is a mobile wallet and workforce management companion application that enables employees to:

• Manage a Wampum (WMP) digital token wallet
• Send and receive WMP tokens
• View and bid on work shifts through their employer's TomaShift platform
• Receive company and Tomahawk Internet Technologies news

3. Wampum (WMP) Token Disclaimer

Wampum (WMP) tokens are a proprietary, closed-loop digital incentive token used exclusively within employer-operated TomaShift workforce management systems. WMP tokens:

• Are not a cryptocurrency, security, or investment vehicle
• Have no guaranteed monetary value outside of the TomaShift system
• Are similar in nature to employer loyalty points, gift cards, or airline miles
• Are subject to your employer's policies and terms
• Cannot be redeemed for cash by Tomahawk Internet Technologies

Tomahawk Internet Technologies is not responsible for the value, redemption, or policies of WMP tokens as administered by your employer.

4. Wallet Security Responsibility

Your wallet seed phrase (12-word recovery phrase) is generated on your device and stored exclusively in your device's secure storage. You are solely responsible for:

• Safeguarding your seed phrase
• Maintaining access to your wallet
• Any transactions made from your wallet

Tomahawk Internet Technologies cannot recover lost wallets, seed phrases, or tokens. Lost seed phrases result in permanent, irrecoverable loss of wallet access.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or tamper with the App
• Use the App to defraud your employer or other employees
• Attempt to manipulate the TomaShift bidding or rewards system
• Use the App in any way that violates your employer's policies

6. Disclaimer of Warranties

The App is provided "as is" without warranty of any kind, express or implied. Tomahawk Internet Technologies does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, Tomahawk Internet Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of WMP tokens, data, or business opportunities arising from use of the App.

8. Changes to the App and Terms

We reserve the right to modify or discontinue the App and these Terms at any time. Continued use of the App following notification of changes constitutes acceptance of the revised Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to conflict of law principles.
